HIPs Q. Do I need one? A. Since 10th November 2007 HIPs have been required for the sale of three bedroom properties and larger. However, since 14th December, HIPs has been extended to all properties for sale. Q. How long does it last? A. Until the home is sold. Q. Who is legally able to create a HIPs A. Estate Agents, Solicitors and yourself. Q. Who is responsible for the HIPs? A. You are, or the agent acting on behalf of your property. The exemption of a HIPs pack is in the private sale to a family member. EPC Q. What is an EPC? A. It's an Energy Performance Certificate 'EPC' Provides information on the energy efficiency of a property for home owners, tenants and buyers. Q. Is my property exempt from having an EPC? A. No. All properties as of 1st October 2008 for sale, whether previously exempt from having to provide a HIP or not, have to provide an EPC to the buyer. Q. What about rented properties? A. All rented property require an EPC. Q. Can I pass on the cost to my tenant? A. No. However, you can charge for a copy. Inventories Q. What is an Inventory? A. The document that outlines the contents (and state thereof) of the property. The list includes everything from the furniture, fixture & fittings to doors, walls and ceilings. Created at the start of a tenancy and becomes a legally binding document once signed by both tenant and landlord. Q. Do I need one? A. Its not compulsory, but I would advise every landlord to have one. It forms the basis for any dispute at the end of a tenancy, and without one a claim against the tenants deposit will be hard to fight. Q. If my property is unfurnished, do I still need one? A. Yes. Any damage to the properties fixtures and fittings will be covered. Q. What is a Check In? A. The Check In report compares the inventory (as above) on the first day of the tenancy to ensure both parties are satisfied with the contents. This will bind the parties as a legal document once signed. Q. What is a Check Out? A. The Check Out report compares the Check In report with the condition of the property on Check Out. Any differences are highlighted so that further action can be taken. Q. Do I have to provide photographs? A. When we carry out any inspection we provide digital photographs. This presents proof of any damage that may have occurred under the tenancy. Q. Can I prepare my own Inventory? A. Yes. But I advise against it! A independent survey by a trained person can help in any legal action/dispute. By doing the report yourself you might miss something that leads to financial loss later on. Inventories prepared by Landlords are not looked upon favorably by the legal profession.
